Return Policy

Effective Date: 1 January 2025

This Return Policy (hereinafter referred to as the “Policy”) governs the circumstances under which Bard Feeder (hereinafter referred to as “the Company,” “we,” “us,” or “our”) will or will not accept returns, exchanges, or refunds for items purchased via our platform (hereinafter referred to as “the Site”). By placing an order on the Site, you (hereinafter referred to as “the Customer,” “you,” or “your”) acknowledge and irrevocably agree to adhere to the stipulations outlined in this Policy in their entirety.

1. General Provisions

 

1.1. Nature of Goods Sold: The products available for purchase on the Site are sourced directly from third-party manufacturing and logistics entities based in China and are shipped directly to Customer locations within the United States. The generic nature of the product title, such as “Smart Bird Feeder,” in lieu of explicit Bard Feeder branding or proprietary markings, is a feature inherent to the Company’s operational framework and shall not be considered a defect, misrepresentation, or basis for return.

 

1.2. Finality of Purchase: All transactions executed on the Site are deemed final, binding, and non-negotiable. Under no circumstances shall the Company entertain requests for returns, exchanges, or refunds, regardless of the Customer’s dissatisfaction, change of mind, or subjective assessment of the product’s quality, appearance, or functionality.

 

1.3. Customer Responsibility: It is the sole responsibility of the Customer to review all order details, including but not limited to product descriptions, specifications, and shipping timelines, prior to confirming the purchase.

2. Conditions Precluding Returns

 

The Customer expressly acknowledges and agrees that the following circumstances preclude the possibility of returns, refunds, or exchanges:

 

2.1. Branding and Title Discrepancies: The absence of the Bard Feeder branding on the product, and/or the presence of a generic label such as “Smart Bird Feeder,” does not constitute grounds for dissatisfaction, dispute, or return.

 

2.2. Shipping Delays: While the Company endeavors to ensure timely delivery within the stated shipping period of up to 30 days, delays arising from logistical challenges, customs inspections, or unforeseen circumstances shall not entitle the Customer to seek a return or refund.

 

2.3. Minor Variations: Insignificant deviations in product appearance, color, packaging, or design from images or descriptions displayed on the Site shall not constitute valid grounds for return.

 

2.4. Subjective Dissatisfaction: The Customer’s personal dissatisfaction with the product’s features, utility, or aesthetics shall not be considered a valid reason to request a return or refund.

3. Limited Exceptions

 

3.1. Damaged or Defective Goods: In the rare event that a product is received in a visibly damaged or materially defective condition, the Customer must notify the Company within seven (7) calendar days of receipt by submitting a written request to [Insert Email Address]. The request must be accompanied by clear photographic evidence of the damage or defect.

 

3.2. Company Discretion: The Company, at its sole and absolute discretion, may determine an appropriate resolution, which may include:

• Filing a claim with the shipping carrier.

• Providing troubleshooting guidance to address functionality concerns.

• Offering limited compensation or replacement in extraordinary circumstances, subject to the availability of stock and logistical feasibility.

 

3.3. Exclusions to Exceptions: No action shall be taken under Section 3.1 or Section 3.2 if the damage or defect is deemed to have arisen due to Customer misuse, mishandling, or failure to follow product instructions.

4. Shipping and Risk of Loss

 

4.1. Risk Transfer: The risk of loss, damage, or theft transfers to the Customer upon dispatch of the product from the supplier’s facility in China. The Company shall not be liable for products lost, stolen, or damaged during transit.

 

4.2. Tracking Information: Upon dispatch, the Company shall endeavor to provide tracking details to the Customer. It is the Customer’s sole responsibility to monitor the progress of the shipment and address any delays or issues directly with the shipping carrier.

5. No Refunds Policy

 

5.1. Non-Refundable Transactions: The Customer expressly acknowledges that all payments made in relation to purchases on the Site are final, non-refundable, and non-reversible under any circumstances, including but not limited to:

• Dissatisfaction with product quality or performance.

• Perceived delays in delivery or order fulfillment.

• Incompatibility with Customer expectations or preferences.

 

5.2. Refund Attempts: Any attempts by the Customer to secure a refund through external channels, including but not limited to chargebacks, disputes with payment processors, or complaints to third-party platforms, shall constitute a violation of this Policy. The Company reserves the right to dispute such actions vigorously and to pursue all available remedies, including legal action.

6. Customer Acknowledgment

 

6.1. By placing an order on the Site, the Customer acknowledges and agrees that they have read, understood, and accepted this Policy in its entirety. Ignorance of these terms shall not be admissible as a basis for disputes, claims, or exceptions.

 

6.2. The Customer affirms that they have independently assessed their decision to purchase the product and that no representations, warranties, or assurances beyond those explicitly outlined in this Policy have been made by the Company.

7. Modifications to the Return Policy

 

7.1. The Company reserves the unilateral right to amend, revise, or otherwise modify this Policy at any time without prior notice. Such modifications shall become effective immediately upon posting to the Site.

 

7.2. Customers are encouraged to periodically review this Policy to remain informed of its terms and conditions.
