By engaging with our website, placing an order, or otherwise interacting with our platform, you expressly agree to be bound by the following Terms and Conditions, which constitute a legally binding agreement between Bard Feeder (henceforth referred to as “the Company”) and the user (henceforth referred to as “you,” “your,” or “the Customer”). Your decision to proceed with any purchase or use of the platform indicates your acknowledgment and irrevocable acceptance of these terms.

1.1. Company Registration: Bard Feeder operates as an entity registered under the jurisdiction of India. All financial transactions associated with purchases made on the Bard Feeder platform are processed through Indian banking institutions in accordance with applicable Indian laws and regulations.

1.2. Nature of Products: The Company specializes in facilitating the acquisition of smart bird feeders that are directly sourced from manufacturing entities located in China. Given the nature of this supply chain, the delivered product may bear generic titles such as “Smart Bird Feeder” and may not include explicit Bard Feeder branding or proprietary labeling. Such discrepancies are inherent to the dropshipping model employed by the Company and shall not serve as grounds for disputes, cancellations, or claims.

2. Orders, Payments, and Cancellations

 

2.1. Irrevocability of Orders: Once an order is placed through the Bard Feeder platform and confirmed via electronic acknowledgment, said order shall be deemed final, binding, and irrevocable. The Company does not entertain requests for cancellation, alteration, or amendment under any circumstances.

2.2. Payment Finality: Payments remitted by the Customer in exchange for goods sold by the Company are non-refundable and constitute a final and absolute transaction. The Customer is strongly advised to review all order details with utmost diligence prior to confirming the purchase.

2.3. Discretionary Assistance: While the Company does not obligate itself to accommodate post-purchase inquiries or grievances, it reserves the right to extend discretionary support on a case-by-case basis, subject to limitations and exclusions detailed herein.

3. Delivery and Shipping Terms

 

3.1. Shipping Duration: Products procured via the Bard Feeder platform are shipped directly from China to designated delivery addresses in the United States. Customers should anticipate a delivery timeline extending up to 30 calendar days from the date of dispatch.

3.2. Unforeseen Delays: The Company shall not be held liable for shipping delays caused by logistical impediments, customs clearance, natural disasters, or any other factors beyond the Company’s reasonable control.

3.3. Tracking Provisions: Upon dispatch of the Customer’s order, the Company shall endeavor to furnish tracking details. It is incumbent upon the Customer to monitor the progress of the shipment and liaise directly with the shipping carrier for updates or inquiries.

4. Return, Refund, and Replacement Policy

 

4.1. Exclusion of Refunds and Returns: The Customer expressly agrees that all purchases made on the Bard Feeder platform are final and non-returnable, and that the Company does not offer refunds, replacements, or exchanges under any circumstances, including but not limited to:

a. Dissatisfaction with the product, whether subjective or objective.

b. Receipt of an item bearing generic branding inconsistent with the name “Bard Feeder.”

c. Variations in delivery timelines within the 30-day shipping period.

4.2. Damaged Goods: In the unlikely event that an item is received in a visibly damaged or defective condition, the Customer must notify the Company within 7 days of receipt, providing photographic evidence. The Company, at its sole discretion, may assist in filing claims with the carrier but does not guarantee remediation or compensation.

5. Limitation of Liability

 

5.1. No Warranties: The Company provides all products “as-is” without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

5.2. Shipping Risk: Risk of loss or damage to the product transfers to the Customer upon dispatch from the supplier. The Company disclaims liability for items lost, stolen, or damaged during transit.

5.3. Usage Liability: The Company shall not be held liable for any injuries, damages, or losses resulting from the use or misuse of the product purchased.

6. Intellectual Property and Use of the Website

 

6.1. All materials, trademarks, and content displayed on the Bard Feeder platform remain the sole property of the Company and are protected by applicable intellectual property laws. Unauthorized use of the platform’s materials is strictly prohibited and subject to legal recourse.

7. Dispute Resolution and Governing Law

 

7.1. Governing Law: These Terms and Conditions, as well as any disputes arising therefrom, shall be governed by and construed in accordance with the laws of India.

7.2. Jurisdiction: Any legal actions or proceedings shall be exclusively brought before the courts located in India, to the exclusion of all other jurisdictions.

8.1. By proceeding with a purchase, the Customer warrants that they have read, understood, and accepted all terms outlined in this document. Ignorance of these terms shall not be admissible as grounds for disputes, claims, or legal action.

9.1. The Company reserves the unilateral right to amend, revise, or otherwise modify these Terms and Conditions at any time without prior notice. Customers are encouraged to review the Terms periodically to stay informed of changes.
